1. Introduction

This Privacy Policy explains how AKTICON ("we", "us", or "our") processes personal data when you visit our website akticon.net, use the AKTICON Training Maker at trainingmaker.akticon.net or the AKTICON Training Portal at akticon-trainingportal.netlify.app, contact us, or use our services.

We respect your privacy and are committed to protecting your personal data. Please read this Privacy Policy carefully to understand our practices regarding your personal data.

3. Hosting

Our website, the AKTICON Training Maker and the AKTICON Training Portal are hosted by Netlify, Inc., San Francisco, USA. When you open one of our pages, Netlify automatically processes technical access data in server log files, such as your IP address, the date and time of access, the page requested, the referring URL, and your browser type and operating system.

This processing is necessary to deliver our pages and to keep them stable and secure. The legal basis is our legitimate interest in providing a secure and reliable website (Article 6(1)(f) GDPR). We do not combine this data with other data sources.

Netlify may process data in the USA. Netlify is certified under the EU-U.S. Data Privacy Framework, on the basis of which the European Commission has recognized an adequate level of data protection (Article 45 GDPR). 4. Cookies, Analytics and Fonts

Our website, the AKTICON Training Maker and the AKTICON Training Portal use no analytics or tracking tools, and our website sets no cookies. The only cookies are strictly necessary access cookies: in the Training Maker for invited accounts that sign in to the Sheets Maker (see section 6), and in the Training Portal after you enter your cohort password (see section 7). All fonts are loaded from our own server; no connection to Google Fonts or other font providers is made.

5. Contact Form and Contacting Us

If you use our contact form, we process the data you enter (name, email address, and optionally company, phone number, training type, timeline and your message) in order to answer your enquiry. The form is processed by Formspree, Inc., USA, which forwards your submission to us by email. Formspree hosts its services with Amazon Web Services in the USA. For this transfer to a third country, Formspree relies on the EU Standard Contractual Clauses (Article 46(2)(c) GDPR). If you contact us by email or phone, we process the data you provide for the same purpose.

The legal basis is Article 6(1)(b) GDPR if your enquiry relates to a contract or to pre-contractual measures, and otherwise our legitimate interest in responding to enquiries (Article 6(1)(f) GDPR). We keep enquiry data for up to 2 years for business development purposes, unless statutory retention obligations require longer storage.

6. AKTICON Training Maker (trainingmaker.akticon.net)

The Training Maker is a free browser tool for designing trainings. It combines the Flow Maker (the running order of a training), the Flipchart Maker and, for invited accounts only, the Sheets Maker (participant worksheets and workbooks). It works without an account and uses no analytics or tracking.

Your projects: Everything you create is stored only on your device – either in a folder you select (Chrome or Edge on a computer) or in your browser's local storage on this device (for example on tablets). This content is never transmitted to AKTICON or to third parties. You can delete it at any time by deleting the folder or project, or by clearing your browser data.

Settings: The tool also stores small notes in your browser's local storage, for example which view you last used and that you have already seen the introduction. This information stays on your device.

Google Drive (optional): If you choose to connect Google Drive, your project files are stored in your own Google Drive. The tool is granted access only to the files it creates there (Google's "drive.file" permission) and never to the rest of your Drive. The access permission is kept in your browser only; AKTICON has no access to these files at any time. You can disconnect at any time. Google's processing is governed by the Google Privacy Policy (Google Ireland Limited): https://policies.google.com/privacy.

Sign-in for the Sheets Maker (invited accounts only): The Sheets Maker is available only to invited accounts. If you choose "Sign in with Google" to open it, Google confirms your email address to us. A server function hosted by Netlify compares it with the list of invited accounts. If your address is on the list, it sets one strictly necessary cookie ("tm_sheets") that contains your email address and keeps the Sheets Maker unlocked on this device for up to 30 days. Your email address is not stored anywhere else. If your address is not on the list, no cookie is set and nothing is stored. The legal basis is Article 6(1)(b) GDPR (providing the feature you requested); storing the cookie is strictly necessary for this feature (Section 25(2) no. 2 TDDDG). You can remove the cookie at any time by clearing your browser data.

Hosting: The tool is hosted by Netlify, as is our website (see section 3, Hosting). When you open it, Netlify processes technical access data such as IP address, date and time and browser type in server log files, in order to deliver the tool and keep it secure (Article 6(1)(f) GDPR).

Fonts: All fonts are loaded from our own server. No connection to Google Fonts or other font providers is made.

Links to akticon.net: Links from the tool to akticon.net contain campaign parameters (for example utm_source=trainingmaker). They only identify the tool as the source of the link and contain no personal data.

7. AKTICON Training Portal (akticon-trainingportal.netlify.app)

The Training Portal provides online learning content for participants of our training programmes. It requires no account and uses no analytics or tracking.

Cohort password: To open a programme, you enter the cohort password we gave you. Only the password is sent to our server, which checks it and sets one strictly necessary cookie ("akticon-portal-token"). The cookie contains only which programme you have unlocked – no personal data – and expires after 24 hours. The legal basis is Article 6(1)(b) GDPR (providing the programme content you requested); storing the cookie is strictly necessary for this (Section 25(2) no. 2 TDDDG).

Your name, progress and answers: The name you enter for the greeting, the sections you have completed and your answers in worksheets are stored only in your browser's local storage on your device. They are never transmitted to AKTICON or to third parties. You can delete them at any time by clearing your browser data.

Hosting: The portal is hosted by Netlify (see section 3, Hosting).

8. Client Data

When you engage us for consulting or training services, we process the contact and project data required to perform the contract (Article 6(1)(b) GDPR). We keep this data for the duration of our business relationship and afterwards for as long as statutory retention obligations under commercial and tax law require (Article 6(1)(c) GDPR), typically up to 10 years.

9. Data Sharing and Disclosure

We only share your personal data in the following situations:

  • With Service Providers: With the service providers named in this policy (Netlify, Formspree), who process data on our behalf.
  • With Your Consent: For any other purpose, only with your consent.
  • Legal Requirements: Where we are required to do so by law or in response to valid requests by public authorities.

10. Data Security

All pages are transmitted in encrypted form (HTTPS). No method of transmission over the Internet or method of electronic storage is 100% secure. While we use appropriate technical and organizational measures to protect your personal data, we cannot guarantee its absolute security.

11. Your Data Protection Rights

Under the GDPR you have the following rights:

  • The right of access to the personal data we hold about you (Article 15 GDPR)
  • The right of rectification - the right to have your data corrected if it is inaccurate or incomplete (Article 16 GDPR)
  • The right to erasure (Article 17 GDPR)
  • The right to restriction of processing (Article 18 GDPR)
  • The right to data portability - the right to receive your data in a structured, machine-readable format (Article 20 GDPR)
  • The right to object to processing based on our legitimate interests (Article 21 GDPR) – see the highlighted notice below
  • The right to withdraw consent at any time with effect for the future, where we rely on your consent
  • The right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR). The authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht), Promenade 18, 91522 Ansbach, Germany.

Your right to object (Article 21 GDPR)

Where we process your personal data on the basis of our legitimate interests (Article 6(1)(f) GDPR), you have the right to object to this processing at any time, on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

Where we process your personal data for direct marketing, you have the right to object at any time, without giving reasons.

An informal message to info@akticon.net is sufficient.

12. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will post the new Privacy Policy on this page and update the "Last updated" date at the top. You are advised to review this Privacy Policy periodically for any changes.
